Independent Lending Group respects and protects the privacy of our website visitors and customers.  By visiting and using this website, the user agrees to and acknowledges this Privacy Policy and the Terms of Use.  Please take a moment to read this Privacy Policy carefully. This website, and all other Independent Lending Group’s websites (collectively, the “Websites”) are general audience sites and we do not knowingly collect personal, or other, information from children under the age of 18. We ask that if you are under the age of 18, please do not use our site. If we become aware that any information provided to us is personal information of someone younger than 18 years old, we will delete all information as soon as possible. Please notify us if you or anyone under the age of 18 is using or attempting to use our site, services or products.

We may provide additional “just-in-time” disclosures or information about the data processing practices of specific Services. These notices may supplement or clarify our privacy practices or may provide you with additional choices about how we process your data.

If you do not agree with or are not comfortable with any part or parts of this Privacy Policy, discontinue access or use of our site and services immediately.

Personal Information

To provide benefits and services to our users and clients, Independent Lending Group collects and maintains personal information provided by its users, including names, addresses, mobile telephone numbers, email addresses, and so forth. The amount of information that the user provides is completely voluntary, however providing less information may limit the user’s ability to access all the website’s benefits and all Independent Lending Group’s services. Independent Lending Group may use personal information for routine follow-ups to assess customer satisfaction, to inform users and clients of promotions and information, provide general announcements and so forth. 

Usage and Analytics Data

Independent Lending Group collects usage information in order to assess how users’ access and utilize the site in an effort to improve the website and services provided by Independent Lending Group. Additionally, this data is valuable to the company for many internal purposes, including troubleshooting, improving the sites functionality, and ultimately to provide more benefits and services to the user.  Independent Lending Group also uses this information to enforce our terms in our user agreement and other agreements, to detect and prevent fraud, to provide Independent Lending Group’s Services, to provide Service communications, to provide customer service, to ensure quality control, to ensure network and information security, for research and development purposes, to enhance your experience, to facilitate corporate acquisitions, mergers, or transactions, and/or to engage in marketing activities.

This information includes but is not limited to the user’s internet service provider, type of web browser or operating system, IP address, geographic location, viewed pages, time and duration of site visits, crash logs, webpages visited, technical data collected through cookies, pixel tags and other similar technologies that uniquely identify your browser, and other information relating to the site usage. We may also use identifiers and technology to identify how you clicked through to our site and to recognize you when you access via an external link, such as a link appearing on a third-party site.

For example, Independent Lending Group must identify and verify customers using our Services in order to comply with commercial lending laws across jurisdictions. Sharing User Data

As a general policy, Independent Lending Group uses personal information and message data for internal purposes only. We do not sell or rent information about you. We will not disclose personal information or message data to third parties without your consent, except as explained in this Privacy Policy. 

Sharing with affiliates or acquirers

Independent Lending Group must be permitted to share user data with its affiliated entities, including parent companies and subsidiaries. Furthermore, if Independent Lending Group participates in a merger, stock purchase, asset purchase, or other acquisition, it will be required to share user information with the purchaser or surviving entity. 

Independent Lending Group as a Loan Broker

User acknowledges that Independent Lending Group is a Loan Broker and not a direct lender. Accordingly, to provide services, benefits and products to user, Independent Lending Group, as a broker, will provide certain information to Lenders and other Brokers. User hereby acknowledges that the information provided may thus be provided to these third-party lenders or other brokers.

Text Messages and Emails

To maintain the highest level of communication to provide the best services and benefits to our users, text messages and emails may be used at times. In such situations, Independent Lending Group reserves the right to retain this information indefinitely.

Third-Party Service Providers

Independent Lending Group may need to use personal data in connection with website maintenance, upgrades, new releases, or analytics data review or compilation or in connection with third-party marketing or advertising services. 

Compliance with laws

“The Company cooperates with government and law enforcement officials to enforce and comply with the law. We may therefore disclose personal information, usage data, message data, and any other information about you, if we deem that it is reasonably necessary to: (a) satisfy any applicable law, regulation, legal process (such as a subpoena or court order), or enforceable governmental request; (b) enforce the Terms of Use, including investigation of potential violations thereof; (c) detect, prevent, or otherwise address fraud, security or technical issues; or (d) protect against harm to the rights, property or safety of the Company, its users or the public, as required or permitted by law.”

Security

Independent Lending Group will use necessary measures and reasonable care to protect the security of user’s data. However, it is impossible for Independent Lending Group to completely guarantee that user data will be immune from malicious attack or compromise.  As such, users should understand that the transmission of personal data is always at their own risk and Independent Lending Group accepts no liability for any unintentional disclosure.

If Independent Lending Group discovers a data breach, within 45 days of such breach, Independent Lending Group will notify users potentially compromised users that a breach occurred, what type of information was breached, when the breach occurred, what steps users can follow to further protect their information, what actions Independent Lending Group is taking regarding the breach and any steps to further ensure no future breaches occur.

Independent Lending Group reminds and warns users that account information is sensitive and private and users should not to share account logins, passwords or any other private information with any other individual.

Storage and maintenance of user data in the United States 

The Storage and Maintenance of user data is subject to the laws of the United States of America, regardless of the country from which the user’s data originates.  

Updating user information

Changes to the Privacy Policy

Independent Lending Group hereby notifies users that it may make changes to its Privacy Policy from time-to-time. Users should periodically revisit the policy for any updates. Independent Lending Group will make efforts to notify users of any policy changes. Users who continue to interact with the site following a revision of the Company’s Privacy Policy will automatically be subject to the new terms.

Caution the user Regarding their Own Data safekeeping

Users should safeguard and protect their personal information on this website and other websites, including but not limited to passwords, usernames, location, images and videos. Please do not disclose any private and/or sensitive information to any untrusted party.

Types of Information and Data We Collect

In the process of providing services to Users, Independent Lending Group may request personal information regarding users and businesses. Such information includes but is not limited to personal Identifying information (name, birth date, phone number, address, social security number, email, etc.), Formal Identification Information (EIN numbers, proof of legal formation, operating agreements), Financial Information (bank statements, financial reports, tax documents and financial projections), transcation information (purchase contracts, service contracts, orders, receipts, etc.), and so forth.

Independent Lending Group will use reasonable measures to protect and safeguard such information and documents and shall only share such with lenders and brokers in an effort to provide requested services by Users.  Independent Lending Group will provide, share or disclose such information with no other party, group or individual unless otherwise authorized by User.

California Specific Privacy Rights

Independent Lending Group adopts this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and and any terms defined in the CCPA have the same meaning in this Privacy Policy with Independent Lending Group.

Effective January 1, 2020, pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), California residents have certain rights in relation to their personal information, subject to limited exceptions. Any terms defined in the CCPA have the same meaning when used in this California Privacy Rights section.

  • For personal information collected by us during the preceding 12 months that is not otherwise subject to an exception, California residents have the right to access and delete their personal information. Independent Lending Group will not discriminate against those who exercise their rights. Specifically, if you exercise your rights, we will not deny you services, charge you different prices for services or provide you a different level or quality of services.
  • To the extent we sell your personal information to third parties, you also have the right to request that we disclose to you: (i) the categories of your personal information that we sold, and (ii) the categories of third parties to whom your personal information was sold. You have the right to direct us not to sell your personal information. Independent Lending Group does not sell your information.

Should Independent Lending Group engage in any of the activities listed in this section, your ability to exercise these rights will be made available to you. You can exercise your rights by contacting us at info@independentlendinggroup.com or by contacting customer service at (833) 249-5686.

If you are a California resident, you may designate an authorized agent to make a request to access or a request to delete on your behalf. We will respond to your authorized agent’s request if they submit proof that they are registered with the California Secretary of State to be able to act on your behalf, or submit evidence you have provided them with power of attorney pursuant to California Probate Code section 4000 to 4465. We may deny requests from authorized agents who do not submit proof that they have been authorized by you to act on their behalf, or are unable to verify their identity.

Special Notice to California residents. 

If you are a resident of California, in addition to the rights set forth in this Privacy Policy:

  • We will not share any personal information about you with third parties to the extent prohibited by applicable California law or to the extent your prior consent to share is required by applicable California law; and
  • You have the right to request information from us regarding the manner in which we share certain categories of information with third parties for their direct marketing purposes. California law gives you the right to send us a request at a designated address to receive the following information:
    • the categories of information we disclosed to third parties for their direct marketing purposes during the preceding calendar year;
    • the names and addresses of the third parties that received that information; and
    • if the nature of the third party’s business cannot be determined from their name, examples of products or services marketed.

Special Notice to Vermont Residents

Vermont law places additional limits on sharing information about Vermont residents so long as they remain residents of Vermont. In accordance with Vermont law, we will not share information we collect about Vermont residents to companies outside of Independent Lending Group except: (1) As permitted by law; (2) To companies that perform marketing or other services on our behalf; (3) Name, contact and transaction and experience information to other financial institutions with which we have joint marketing agreements; or (4) With the authorization or consent of the Vermont resident. We also will not share non-transactional information about Vermont residents received from others within the Independent Lending Group family of companies except with the authorization or consent of the Vermont resident.

Choice/Opt-Out

You may request to cease receiving our newsletter or any marketing emails by emailing info@ independentlendinggroup.com or by following the unsubscribe instructions included within the newsletter or marketing emails.

Choosing to not provide certain information or documentation will result in the inability to use certain features and receive certain benefits and services. As a reminder, users should safeguard their personal information and they are solely responsible for posting any personal information on public forums.

Independent Lending Group cannot guarantee that other parties, i.e, lenders and brokers, will not reach out after information is shared in an effort to provide requested services, benefits and/or products from Independent Lending Group.

Federal and State Regulations require that records are maintained for certain periods of time. Independent Lending Group will follow these regulations and will not delete certain information in such situations.
